FAQ

Q1. What can I claim for?
A compensation claim can be made for any personal physical injury or emotional harm, loss of income, damaged car and possessions, or any other financial loss you suffer as a result of your accident.
Q2. What sort of accident claims do you deal with?
We deal with every sort of personal injury claims. We have experienced solicitors who cover every cause of injury and are competent to take on your claim.
Q3. What is a no win no fee agreement?
If a solicitor wishes to act for you (the claimant) on the basis that there is no charge to be made to you, then you must sign a Conditional Fee Agreement. We support this Agreement by ensuring there is insurance to protect you against the award of costs should you lose your claim. So no claim for costs can be made against you regardless of the outcome of your case, so our service will cost you nothing.
Q4. After an accident how long do I have to make a claim?
You must start legal proceedings within 3 years of your accident.
There are two major exceptions to this 3 year rule:
If you were under 18 when the accident happened, then the 3 years only start to run from your 18th birthday
If your injury was not obvious at the time of your accident, then the 3 years may start from when you found out about it.
Q5. Will my claim need to go to Court?
Only a very small percentage of cases go to Court.
Q6. How long will my claim take?
For Road Traffic Accidents under £10,000 a new speedier claims procedure starts 30th April 2010 and it is hoped that most claims will be settled in 4 months. But the answer is really how long it takes to reach a settlement by apportioning blame and agreeing on a compensation sum.
Q7. Do I need to go for a medical examination?
Most injury claims necessitate a medical report from an independent medical specialist and this is used to calculate your possible compensation.
Q8. How much compensation will I receive?
There are guidelines set to determine how much you should receive for your injuries. Your solicitor will make a recommendation based on how severe your injuries are and all associated factors of your age, gender, how long you have suffered plus how long you may be affected, if your injuries are visible, employment issues, financial losses, the effects on your future earnings, lifestyle, social and sex life.
Once a medical report is available your solicitor will give you guidance on what your claim will be worth.
Q9 Do I have to visit my solicitor?
Definitely not as your appointed solicitor will deal with your claim over the telephone and in writing.
Q10 Will I get 100% compensation?
In the majority of cases, the solicitor's fees are paid by the opposition, so you get 100% of your claim. Solicitor firms have their own marketing budgets which they use to advertise direct to the public or pay fees to Claims Management companies. So any fee money comes from the solicitor and certainly not from your compensation sum.
Q11 Can I claim if my car accident concerns an uninsured, stolen or not traced vehicle?
Provided you have immediately reported the incident to the Police, you should be able to make a claim.
